Terms and Conditions of Sale - Pulse Tech (UK) Ltd (www.TheCharmWorks.com)

The following terms and conditions apply to all transactions on www.TheCharmWorks.com or with Pulse Tech (UK) Ltd. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully.

General
These terms and conditions do not affect your statutory rights. To order goods through our website or over the phone you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Images & Description of Goods
All images, descriptive matter, specifications and advertising on our site and adverts are for the sole purpose of giving an approximate description of the goods. All images are the property of Pulse Tech Uk Ltd and may not be used without permission.

Accuracy of Product Information
Some product specifications, images and other information published on our website has been gathered from public-domain sources. The intention of Pulse Tech is that all information on the website and adverts should be as accurate and up to date as possible. However, Pulse Tech cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the customer are the responsibility of the individual and Pulse Tech accept no responsibility for these. Please note weights and dimensions given on the website and wholesale documents are approximate and may vary as castings will not be exactly the same every-time.

Payment and Price
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. As previously stated should the price change or be incorrect the contract is void and must be restarted by you the consumer. All prices on our website include VAT ( GB 942 0747 28 ) for UK Customers. Prices are unless stated exclusive of delivery charges which will be payable as indicated at the time of placing your order. Any offers made by email, post or phone to supply goods are not binding until a dated final pro-forma has been issued by PDF, Fax or Mail.

Typographical Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit in the value of the incorrect price (including delivery charges).

Payment Methods
We accept all major credit and debit cards including Visa, MasterCard, Switch, Solo and Maestro through thrid party payment gateways of Paypal and SagePay. When ordering you must provide us with your exact billing address and telephone number - the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.

If your transaction is declined because of an incorrect billing address / CCV / address verification error a shadow for the transaction ( pre-authorisation ) will appear on your account for each payment attempted. This may remain on your card for a number of days but the exact period depends on the issuing bank of the card. Some transactions will go through an further level of fraud prevention, Pulse Tech may need to contact you on your given telephone number. If you give an incorrect number it may result in your transaction being cancelled. You may also pay by cheque or postal order although we cannot dispatch the goods until payment has been cleared which can take up to 6 working days. You can also pay by Cheques, Postal and Money orders. We aim to process these transactions the day the payment clears.

Discount and Promotions
The free delivery offer provides free 1st class delivery on all UK orders over £20. All other delivery options will still incur a charge.

Suitability of our product's for Children.
Our product's are not suitable for children. Please note all items of jewellery, charms and bracelets are not intended for wearing by children as small parts may represent a hazard. Children should always be supervised by an adult when with around any item of jewellery. The Swarovski crystal's and CZ used in some items do contain an amount of lead, as does most crystal and thus represent a hazard if swallowed.

Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods. "In Stock" item indicates the item is available from the manufacturer and can be ordered on request.

Delivery Charges
All prices on our website are exclusive of delivery charges which will be added to the price of the products at our checkout. Delivery prices quoted are for most UK Mainland addresses. Northern Ireland(BT), Isle of Man(IM), Scottish Highlands and Orkney Isles(PA, ML, EH, KA, G, KY, PH, DD , AB , IV, KW), Outer Hebrides and the Shetland Isles(HS, ZE) will incur additional charges and may also experience delivery delays. AM/PM and Saturday deliveries are optional and will also incur additional charges. These can be obtained upon application.

Delivery Times
Delivery times will also depend on the shipping method chosen, we aim to dispatch all orders the next working day. Though in the run up the Christmas dispatch times may be extended. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. If we are temporarily out of stock, we will notify you of this position immediately. If there is going to be a delay we will always offer you a refund for the full amount of the order.

Missing Orders
All customers will get an item dispatched email when their order is posted. This is the actual day of posting and this is only sent after an order is dispatched. If an order does not arrive within the specified delivery time we will do our best to investigate the order. Items sent Special Delivery can normally be replaced if they have not arrived within 7 working days. As for all other methods of postage, we can not report them lost until 15 working days ( Royal Mails Official Policy ) have lapsed since the order was sent. Only after this period can we dispatch replacement items.

Risk
As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied should be noted on the delivery consignment note at the time of delivery.

Time Limitation for Notification of Claims
Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 7 days from delivery.
Shortages: It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages should be noted on the consignment note and we should be notified within 7 days from delivery. Any shortages within in the delivery will have to be reported with 7 days of delivery
In-Correct Goods: It is your responsibility to notify us of any in-correct goods supplied within 7 days from delivery.
Non-Deliveries: Good that have not arrived 14 days from the expected delivery date ( UK ) or 21 days ( Rest of world ) should be reported to us so we can refund or replace the order.

Custom crafted orders for example custom charm bracelets are subject to a £5 fee to cover the assembly/disassembly.

Cancellation of Orders

Returned Goods


You may cancel your order for any reason within 7 days of receiving your goods (the 'Cooling-Off Period'). All Goods cancelled within the Cooling-Off Period must be returned to us. If you wish to cancel Goods within the Cooling-Off Period please notify us (by phone, or in writing) and we will issue a refund within 30 days. If cancelling goods within the Cooling-Off Period, it is your duty to take reasonable care of the Goods and return them to us in original condition.

Outside the cooling off period should you want to return your purchase for any reason, you can do so within 21 working days from date of delivery for full credit or refund less any applicable delivery charges. Please note if delivery was free under promotion the refund will be less the normal postage charge. If there is a fault with the item outside normal wear and tear up to 12 months then we will repair or replace it.

Where goods are refunded, the original postage costs for those orders will only be refunded for those sent originally by standard 1st class and 1st class recorded post. Postage costs will not be refunded for special next day delivery and saturday guaranteed post.

Other
Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice.

TheCharmWorks Weekly Charm Prize Draw Competition – Terms and Conditions

1. Entry to this competition is free.
2. The official start date of the competition is Thursday 22/9/2011
3. The competition will run until Thursday 24/11/2011, when the competition will officially close at 12 noon. TheCharmWorks withholds the right to alter the competition closing date and time.
4. No purchase is necessary to enter this competition. To enter, entrants must simply ‘like’ TheCharmWorks Facebook page (www.facebook.com/thecharmworks). All previous Facebook ‘likes’/’followers’/’fans’ are automatically entered into the competition having ‘liked’ the page before this point.
5. The prize draw will be drawn every Thursday (starting 22/09/2011, ending 24/11/2011) before 12:00noon. A random number will be generated and the Facebook Fan who’s number corresponds to the random number will win the draw that day. Each Facebook fan’s ‘number’ is that which corresponds to the order in which they ‘liked’ TheCharmWorks Facebook page ompared to others. The 1^st person to have ‘liked’ TheCharmWorks is therefore given number 1…the 120^th person to ‘like’ us is number 120 etc. Contact TheCharmWorks if there is any confusion regarding the above.
6. The competition prize is a sterling silver/enamel/crystal charm of the winner’s choice. The budget is limited to £19.50 for the one charm.
7. Only one charm can be chosen.
   
8. Only one entrant will win per week.
9. Each Facebook fan is only able to win the draw once. A list of all winners will be kept to ensure that each week there is a different winner.
10. All products at www.thecharmworks.com are subject to availability.
11. The ‘prize charm’ cannot be substituted for a cash alternative in any way.
12. The ability to claim a winning charm expires 3 months after the date the winning draw was completed.
13. No geographical restrictions apply; although standard shipping to outside the UK will apply.

16. Only one entry per person may be submitted. 19. The winner will be able to chose their prize as soon as they have been notified for up to 3 months after the day of the draw.
